Weights & Measures Service Registration

Who Is is required to register employees as a service person or their business as a service agency? 

§47-1-8. Requirements for the registration of service persons and service agencies for commercial weighing and measuring devices.

The uniform regulation for the voluntary registration of service persons and service agencies for commercial weighing and measuring devices as adopted by the national conference of weights and measures and published in national institute of standards and technology handbook 130, "Uniform Laws and Regulations" and supplements thereto or revisions thereof, shall apply to the registration of service persons and service agencies in the state, except insofar as modified or rejected by legislative rule.

Are Business required to use certified devices?

§47-1-21. Registration of business.
On or before the first day of October, one thousand nine hundred ninety-four, every commercial business in the state which, in the course of conducting business, utilizes weights, measures and weighing and measuring devices covered by this article shall obtain a certificate of device registration for the commercial devices covered by this article, from the division. After the first day of October, one thousand nine hundred ninety-four, it shall be unlawful in the state to conduct business subject to the provisions of this article without having first obtained a certificate of device registration from the division. Application for a certificate of device registration shall be made on a form provided by the division. A certificate of device registration is valid for twelve months from the date of issue. The certificate of device registration shall be posted within the place of business.

Can a service company place a device back in service after repair or installation?

It is unlawful for businesses to use weighing or measuring devices that have not been tested and sealed using certified and traceable standards.  However, it would be unfair for businesses to wait for the limited number of state inspectors to test their devices each time service is performed on them.  

The Service Registration program sets conditions for private agencies to perform service, repair or replace weighing or measuring devices and return them to commercial service until a state inspector can arrange to re-inspect the device.  In order to qualify for this status, a service agency must have accurate and traceable standards and certify that each agent who performs work is trained in the applicable area of expertise.  (Complete Active Service Agency Listing)
Although more notice is required for some installations, service agents are required to notify the Weights & Measures office within 24 hours of conducting repairs or service to devices.  Additionally, agents must affix a registered physical seal to devices which prevents tampering until official re-inspection by Weights & Measures takes place.
