Wage Bonding

Every employer, person, firm or corporation engaged in (or is about to engage in) construction work (not relating to a single family dwelling or family farming enterprise), or the severance, production or transportation of minerals (excluding railroads and water transporters), is required to post a wage bond with the Division of Labor for the sole purpose of protecting the wages and/or fringe benefits of its employees. The Division of Labor maintains the bond in its possession until such time that the company becomes eligible for the bond to be released, or to be used to pay employee wages or benefits. Companies that have maintained a payroll in West Virginia for a period of five years are exempt.
